By downloading, installing, or using the AI Hair Salon mobile application ("App"), you agree to this User Agreement ("Agreement"), our Privacy Policy, and any other legal notices published within the App.This Terms of Use Agreement ("Agreement") applies to your access and use of mobile applications.
If you access or use our Services on behalf of another person, you confirm that you have the authority to accept this Agreement on their behalf and that they agree to take responsibility for any violations of this Agreement committed by you or them.
If you do not agree to the terms of this Agreement, you must refrain from accessing or using the Services, cancel any subscriptions, and promptly delete any copies of our Apps from your devices.
IMPORTANT: AI Hair Salon RESERVES THE RIGHT TO MODIFY THIS AGREEMENT AT ANY TIME AT ITS SOLE DISCRETION. If you do not accept the updated terms after being notified of any changes, you must discontinue using the Services, including the website and mobile application. Continued use of the Services after any such changes will be deemed as your acceptance of the revised terms. PLEASE REGULARLY REVIEW THE WEBSITE TO STAY INFORMED OF THE LATEST VERSION OF THIS AGREEMENT.
In the event that you violate any terms or conditions outlined in this Agreement, we reserve the right to terminate your access to the Services immediately and without prior notice.

Subject to this Agreement, we grant you a limited, non-exclusive, non-transferable, and revocable license to use the App solely for personal, non-commercial purposes.
Our Services are intended to address personal needs and are not designed for entrepreneurial, commercial, or business purposes. If you are a legal entity or an individual using these Services on behalf of a legal entity, you must refrain from agreeing to this Agreement and should not use the Services. Individuals are permitted to use our services exclusively for personal purposes.
It is your responsibility to ensure all necessary arrangements are in place to access and use the Services. Additionally, you are accountable for all activities conducted through your account.
You must comply with all applicable laws, honor any contractual obligations, respect intellectual property and other third-party rights, and avoid committing any torts. You are solely responsible for your actions while accessing or using our Services. By using the Services, you agree to adhere strictly to the terms of this Agreement as well as all relevant national, state, and local laws, regulations, and rules. While using the Services, you are prohibited from: Copying, modifying, or distributing any part of the App without prior written permission; Engaging in unauthorized access, hacking, or any activity that may disrupt or interfere with the App's functionality; Using the App to upload, share, or distribute content that is illegal, offensive, defamatory, or violates the rights of others; use the Services, AI Hair Salon Content or Transformed Content for scientific, educational or other research purposes; or, in our sole discretion, is deemed objectionable, interferes with or restricts another person's ability to use or enjoy our Services, or could potentially cause harm or liability to AI Hair Salon or others in any form.
All users who are minors (generally under 18 years old) in their jurisdiction must obtain permission from a parent or guardian and use the Application under their direct supervision. Therefore, if you are between thirteen (13) and seventeen (17) years old and wish to use, download, install, or access the Application, you must: (a) ensure and confirm (if required) that your parent or guardian has read and agrees to this Agreement before your use of the Application; and (b) be able to enter into a legally binding contract with us, without any applicable legal restrictions.
Parents and guardians must supervise any use of the Application by minors directly. Parents and guardians are responsible for preventing minors below the legal age of majority or the applicable legal age in their jurisdiction from using the Application in unauthorized, irrelevant, indecent, and/or unethical manners.
No person under the age of thirteen (13) is allowed to download, install, access, or use the Application.
You confirm that you are at least eighteen (18) years old, an emancipated minor, or have legal parental or guardian consent, and are fully competent and qualified to agree to the terms, conditions, obligations, acknowledgments, representations, and warranties stipulated in this Agreement and to comply with and abide by this Agreement.
All intellectual property rights in the App, including but not limited to software, designs, text, graphics, images, artwork, photos, videos, illustrations, trademarks, trade names, page headers, button icons, scripts, service marks, logos, slogans, and filters, are owned by HONG KONG HAPPY MOBILE TECHNOLOGY LIMITED or its licensors.
You may not use any of our trademarks, logos, or branding without prior written consent. Any use of our Services or AI Hair Salon Content beyond what is expressly permitted in this Agreement is strictly prohibited without our prior written consent and will lead to the automatic termination of the licenses granted under this Agreement. You must not remove, modify, or obscure any copyright, trademark, watermark, service mark, or other proprietary rights notices embedded in or accompanying the AI Hair Salon Content and/or Transformed Content.
You retain ownership of the content you upload, create, or edit using the App ("User Content").
By uploading or creating User Content through the App, you grant us a worldwide, royalty-free, non-exclusive license to use, modify, store, and display your User Content solely to provide and improve the App's services.
You are solely responsible for ensuring that your User Content does not infringe any third-party rights or violate applicable laws.This includes, but is not limited to, compliance with applicable intellectual property laws and data protection and privacy regulations.
AI Hair Salon does not serve as a backup service, and you agree not to rely on the Services for backing up or storing User Content. To the extent permitted by law, AI Hair Salon is not liable for any modifications, suspensions, or discontinuations of the Services, nor for the loss of any User Content or Transformed Content.
By using the free version of the App, you acknowledge and agree that AI Hair Salon may add its watermark to Transformed Content, which in some jurisdictions may be deemed as self-advertising and self-promotion. The manner, mode and extent of such advertising and promotions are subject to change without specific notice to you. Unless you are located in the UK or the EU, you acknowledge that we may not always identify sponsored content, or commercial communications as such. If you are located in the UK or the EU you acknowledge and agree that all advertisements and promotions are recognized as sponsored content or commercial communications by default.
Subscriptions to the Services can only be purchased via third-party marketplaces (e.g., through the Apple App Store or Google Play Store). AI Hair Salon does not sell any paid subscriptions directly, distribute any paid content and/or process payment for any services or purchases directly. If you purchase any subscription through a mobile purchase or third-party marketplace (e.g., through the Apple App Store or Google Play Store), the refund policy applicable to that third-party marketplace will apply. The third-party marketplace will be solely responsible for making refunds under its refund policy, and AI Hair Salon will have no refund obligations. AI Hair Salon disclaims any responsibility or liability related to any third-party marketplace's refund policy or the third party's compliance or noncompliance with such policy.
Your use of the App is subject to our Privacy Policy, which explains how we collect, use, and share your personal information.
We do not control, endorse, or take responsibility for any User Content or third-party content available on or linked to by our Services.The App is provided "as is" without any warranties, express or implied. To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from your use of the App.
TO THE MAXIMUM EXTENT ALLOWED BY LAW, AI Hair Salon AND ITS AFFILIATED PARTIES WILL NOT BE HELD LIABLE TO YOU UNDER ANY LEGAL THEORY—WHETHER ARISING FROM CONTRACT, TORT, NEGLIGENCE, STATUTORY DUTY, STRICT LIABILITY, WARRANTY, OR OTHERWISE—FOR:
INDIRECT OR SPECIAL DAMAGES: THIS INCLUDES CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, PUNITIVE, OR SPECIAL DAMAGES.
SPECIFIC LOSSES: THIS COVERS LOST PROFITS, REVENUE, BUSINESS OPPORTUNITIES, CONTRACTS, ANTICIPATED SAVINGS, GOODWILL, DATA, SOFTWARE, OR ANY DIRECT OR INDIRECT DAMAGES RELATED TO SUCH LOSSES, EVEN IF AI Hair Salon OR ITS AFFILIATES HAVE BEEN ADVISED OF THE POTENTIAL FOR SUCH DAMAGES.
MOREOVER, AI Hair Salon AND ITS AFFILIATED PARTIES ARE NOT RESPONSIBLE FOR ANY DELAYS OR FAILURES CAUSED BY CIRCUMSTANCES BEYOND THEIR REASONABLE CONTROL. SUCH CIRCUMSTANCES MAY INCLUDE, BUT ARE NOT LIMITED TO, GOVERNMENTAL ACTIONS, ACTS OF TERRORISM, PANDEMICS, EPIDEMICS, NATURAL DISASTERS (E.G., EARTHQUAKES, FLOODS, FIRES), LABOR DISPUTES, POWER OUTAGES, OR DISRUPTIONS TO INTERNET SERVICES.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE AGGREGATE LIABILITY OF AI Hair Salon AND ITS AFFILIATED PARTIES FOR ANY CLAIM RELATED TO THIS AGREEMENT OR THE USE OF OUR SERVICES, REGARDLESS OF THE LEGAL BASIS, IS LIMITED TO THE GREATER OF EITHER THE AMOUNT YOU PAID FOR ACCESSING OR USING THE SERVICES, OR ONE HUNDRED HONG KONG DOLLARS (HKD 100).
These limitations do not exclude or limit liability for fraud, fraudulent misrepresentation, death, or personal injury caused by the gross negligence of AI Hair Salon or its affiliated parties, nor do they apply to any other liabilities that cannot be legally excluded or limited. Additionally, some jurisdictions may not permit the exclusion or limitation of incidental or consequential damages, meaning that certain aspects of the above limitations might not apply to you.

To the maximum extent allowed by applicable law, you agree to indemnify, reimburse, defend, and hold harmless AI Hair Salon, its affiliates, beneficiaries, and their respective officers, directors, agents, partners, and employees (collectively referred to as the "AI Hair Salon Parties") from and against any losses, liabilities, claims, demands, damages, costs, or expenses ("Claims") arising from or connected to:
1. Your access to or use of our Services in a manner not authorized under this Agreement;
2. Your User Content, Transformed Content, or Feedback;
3. Your breach of this Agreement or violation of applicable laws; or
4. Your infringement, misappropriation, or violation of any third-party rights, including but not limited to intellectual property or privacy rights.
You agree to promptly inform the AI Hair Salon Parties of any such third-party Claims, cooperate with them in their defense, and bear all associated fees, costs, and expenses, including reasonable attorneys' fees, to the fullest extent permitted by law. Additionally, you acknowledge that the AI Hair Salon Parties have the right to control the defense or resolution of any third-party Claims.
These obligations are supplementary to and do not replace any other indemnity provisions outlined in separate written agreements between you and AI Hair Salon or its affiliates.
We may suspend or terminate your access to the App at any time, with or without notice, for violations of this Agreement or other lawful reasons.
Upon termination, your right to use the App ceases immediately. Any provisions of this Agreement that should survive termination will remain in effect.
You represent and warrant that (a) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country, and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.
THIS AGREEMENT IS GOVERNED BY THE LAWS OF THE HONG KONG SPECIAL ADMINISTRATIVE REGION. ANY DISPUTES ARISING UNDER THIS AGREEMENT SHALL BE RESOLVED EXCLUSIVELY IN THE COURTS OF HONG KONG, WITHOUT REFERENCE TO ANY CONFLICT OF LAW RULES OR PRINCIPLES THAT MIGHT RESULT IN THE APPLICATION OF THE LAWS OF ANOTHER JURISDICTION.
